fun fact: on the back of the old man's shirt it says: I AM A MOTHERFUKER

Once the black guy touched him it was technically assault at that point. He had every right to knock him out, regardless of their little argument.

Actually, it was battery. Battery is an unconsented/unlawful harmful or offensive touch. Assault is basically the overt threat of battery. (IAAL)
