legal question

so i got busted with 1.1 grams of weed on the 20th of Aug. i got a good lawyer and just started some diversion program... this is my first offense and my first time dealing with such matters btw.

anyways, my lawyer sent me my first letter yesterday since starting the diversion program. in it he states that my appearance is required in court on the 21 of this month, but in corner he wrote in pen "don't freak! it's only a status hearing, not a trial."

...no mention of a drug test in any of these papers, sooo wtf? will i get drug tested? this is my first time appearing ANYWHERE, but the jail, since the arrest. what are the ramifications for a failed drug test at one of the status hearings lol?

yea, i'm going to show up all innocent and astute, willing to take whatever they throw at me. plus, this is a pretty bs case in their eyes, it has to be, i mean, i got arrested for a call related to someone completely different robbing a neighbors house. i just happened to be at the wrong place at the wrong time. but seriously, i'm rather concerned of the possible ramifications of failing a test at this hearing-majig. if there even is one! that's what is most concerning to me, the fact that i have had no warning of what to expect upon showing up, other than a likely (in my mind) drug test.

jesus fucking christ. what do you think the consequences will be? could there be any other? they would have to present some amount of evidence. maybe you can deal to save the time and effort for them.

i guess it all depends on where you live? and how much you have on you.

in the UK you'd get it taken off you, obviously, and a 'street caution'.

meaning, dealt with there and then. - slapped wrist and don't do it again you naughty boy.

but it's noted. so if you're caught with it again it gets serious.

you'll be ok man. it's only weed. i don't think you'll get drug tested. that seems pointless to me.

yes perhaps i can... i'll observe how the judge, people, or whatever approaches me from his/her throne, and i will start the "bending-over" accordingly. i'm pretty flexible

yes, i'm hoping my lawyer has some tricks up his sleeve. i'm thinking about trying to call him just to ask the same old questions, talk about pink floyd, something to soften him up a little.

and no way do i want probation, i'm fine with the classes and the community service, but probation is indeed a major pain in the ass.

what's the law for posessing a gram of weed in the us?

in the uk the police would take it off you, give you a yellow slip, and tell you to fuck off. i got caught with 1 gram of high grade and cctv evidence showing me giving my mate a few spliffs and taking a tenner off him, i got 120 hours community service and so far it hasnt affected my life atall. then im again im a techno addicted musician student layabout fuck so maybe when i try and enter the real world il start seeing some consequences

Better question: what state do you live in and what are the laws there? In MA, for example if you're caught carrying less than an ounce with no obvious intent to distribute they give you a ticket to pay and send you on your way.

i think a drug test is far too expensive to waste on a small fish such as you seem to be... that sounds quite offensive but its supposed to help.

I can't imagine they would demand a drug test at your first appearance.

never heard of anyone getting drug tested at a status hearing (usually that happens in your PO's office), but i agree with xxx:

(lots of water, b vitamins, calcium [tums or something similar], creatine, niacin)

probation is definitely a pain in the ass. if they offer you a few days of jailtime and a fine (or just a fine), i'd take that. it's over way quicker and it costs a lot less than paying fees for and attending a bunch of "correctional" classes taught by absolute nuts.
