i'm with travis 100%. the fact that this dude took his complaint to the press discredits his position imo. if this guy has a beef with permission, he should come correct and work it out man to man.

this kind of shit is beneath travis, he should just make "now u know the deal 4 real" part 2 and blast dj clent off the planet with its lush pad/melody combo over a wicked beat. 4 real.

how do you feel travis is acting like a douchebag? he seems like he's being pretty honest unless I'm missing something.

also, the issue is that he didn't get permission to use the sample, not that the sample use itself was some travesty (Travisty), so imo the race card is uncalled for. if he clears samples it's not racist? was it racist when de la soul didn't clear the turtles sample off 3ft high? and if so was in no longer racist when they paid the band a million dollars?

I think there are a couple of intersecting but distinct issues at play here. there is a greater conceptual issue about sampling as an art form and the politics that accompany it. imo, as a purely creative process i think everything is permitted as far as sampling goes, no source material should be off limits. however, when you put a sample-based work out into the public sphere it acquires a variety of contexts which have ramifications -- cultural, political, legal, professional, etc. I think these contexts are impermanent and continuously in flux, especially since copyrights are finite, laws change and bc over time recorded sounds become more acceptable source material (if travis sampled beethoven no one would give a fuck). this whole realm of theory is most interesting to me but I think there is a much less important issue at play here which determines the quality of the issue, i.e. how the situation has been handled by those involved. imo, going to the press before discussing the issue between artists is bullshit. I would completely understand if travis was giving this guy the zomby/timbaland treatment, blowing off his concerns and distancing himself from his actions. but if we are to believe travis this guy didn't give him a chance to respond before going to the press. and he is totally candid about using the sample and saying he meant no harm and it was just a bit of fun. so pray tell, what can be gained by taking this to the press? dude should have just talked it out and if he's not cool with the sample, wants to be paid, whatever, travis should recognize.

I suppose my point is that this did not need to become some scandal of the week media stunt. if travis bullshitted this guy and gave him the cold shoulder then maybe it's time to hit up the press and be like "hey this guy used my song, didn't ask and won't fucking acknowledge my work." but it seems premature for that and I think travis has a right to be pissed if in fact he was just having a bit of fun and is totally willing to work with clent on using the sample.

as for the racial thing i don't think that really needs to come into play here. this doesn't strike me as some egregious exploitation where some big name was getting away with stealing from some powerless minority. just seems like one dude sampling from another. it's kind of hard to believe this is still capable of causing such a stir.

Agreed though T isn't doing hiself any flavors by drooping down to this guy's level. This shit could've literally been sorted over text messages. Travis probably would've said my bad, honest mistake, yadayada, and if he really did want to release it offer to license/clear the sample. This Clent fool could then either deny him or take a negotiated cut.

just from glancing around it looks to me like theres a good chance he's used something without authorizing it at some point

but if he's never used samples to make tracks, without getting them cleared first, then ok he's not a total bitch and his anger is maybe understandable. although if MD really only had one day to reply to him (and maybe MD is lying here, who knows), then the dude is being a bit hasty and i would agree with MD that it's unprofessional to go straight to press. and i find MD's assertion that he was 'given' these samples by someone and told they were OK to use, a bit questionable, but maybe it's the case, in which case MD trusted the wrong person but it doesn't make him a total dick. either way he's def not zomby. it was a sample and he built a track around it

but really if i were MD i would start looking into this guys tracks, find examples of samples, and contact the original owner of said samples to see if they were cleared. legally MD or ninja tune, whatever, will prob have to pay this guy, but seriously, if he has 'stolen' samples in the past himself, fuck him
