if they had only sampled one track, they might have got away with it.. but two distinct samples from the same artist, back to back.. dumb move.

I can't either. Was finally getting around to purchasing some Ulrich thanks to Pandora and got to wondering. Maybe the legal battle still rages on. These things can go on for a while.

I hate when these things just kind of fade away in the press. Same thing with the Timbaland vs Jane Sunni plagiarism case...

Hopefully no news = settled out of court. Anytime the majors have paid up for such sampling bullshit, it's usually kept quiet.

This is weird. Reminds me of Vanilla Ice/Queen and Verve/Stones. Generally, I hear similarities in some songs from stuff in the past, and it makes me wonder if it was intentional or not. Props to Coldplay last summer for playing all Ulrich Schnauss before they came on stage.

Ironically, Coldplay themselves were accusing of riff-stealing/plagarism on their last album.

I think this differs from the Vanilla Ice/Queen or Verve/Stones cases because G'N'R ripped off a independent artist and tried to get away with it. That's why I brought up the Timbland/Tempest (Suni) example. Vanilla Ice sampled a major band, his single became huge (it was originally a B-side), and he tried to act like it wasn't a big deal. It was just as the hip-hop community finally started getting in trouble for sampling, before that it was a free for all. Since they were all on major labels, it was settled out of court. The Verve one was bullshit. They got it cleared but the Stones sued after the song charted, and eventually got all the royalties. Either way, those were both major label-suing-major label examples.

it seems like countless artists such as Boards of Canada, M83 and Fennesz could have easily filed a similar suit.

I like that line from the RS article. It's all like "hey man nobody can tell the difference between this synthesizer shit. It's impossible, it's all identical. There aren't even any words on it!"
