The definition of fair use, while nebulous in many cases, definitely would cover this, at least in the US.

It's still too risky - WARP would probably be fine in court, but assuming Depeche Mode actually wanted to file a lawsuit or cease and desist or whatever it'd be a messy pain in the ass for WARP, costing a lot of time and money. If you chop something up and sample it in a very clever way as a relatively underground producer, you'll most likely be fine. Autechre isn't Top40 but they are fairly well known as electronic producers, so that said, this is about as iffy and grey area as you can get.

 

This year a rather small label, Astrodynamics had a pull this track from streaming and digital download copies of 1991's release, which people quickly figured out was a fairly long loop from a Cure song:

 

 

On the other hand, a bigger indie label called Mexican Summer has never had legal issues with Washed Out's generous sample of this (it's even been licensed in an IFC show!):

 

 

I've also noticed The Field has never been cited for his numerous samples on whosampledwho...I can only assume Kompakt asked for them to be taken down. Also, Daft Punk credited most samples on Discovery, except this one.
